Abstract: Currently, China's data element market is well-operated, with data trading markets gradually established in various regions, the number of professional data enterprises continuously increasing, and the operating rules of the data element market constantly improving. However, theoretically speaking, there are still unfavorable factors in the construction of China's data element market, such as unclear ownership, pricing difficulties, significant constraints from interpersonal relationships, unclear responsibilities for public data management, and insufficient positive incentives for data transactions. From a practical perspective, there are still problems with the construction of a unified national market for data elements, such as inconsistent data infrastructure construction in different regions, high transaction costs, unclear public data management responsibilities as well as trading entities, and a lack of a fallback mechanism for data usage risks. Therefore, it is necessary to improve the national unified data element management system, encourage trial and error, coordinate the construction of a data security supervision system, improve the open and cooperative data space development ecology, vigorously strengthen the support services for the development of the data market, in order to better promote the construction of a national unified data element market.
